Economic Declaration (RDE)

If your company has a foreign partner (Individuals or Legal Entities), you must send to the Central Bank of Brazil the Economic and Financial Statement of Foreign Capital in Brazil (DEF), through the RDE system, which consists of updating the information regarding the capital stock, shareholders’ equity, paid-in capital.
If your Shareholders’ Equity is below R$ 250,000,000.00 (two hundred and fifty million reais), the information should be updated annually, with a base date of December 31 of the previous year.
The Economic Declaration (RDE) deadline for delivery is due 03/31/2020, date defined in the legislation.
For companies whose Net Equity exceeds this amount the declaration will be quarterly with the following base dates:
- Referring to the base date of March 31: until June 30;
- Referring to the base date of June 30: until September 30;
- Referring to the base date of September 30: through December 31; and
- Referring to the base date of December 31: until March 31 of the following year.
The penalty for noncompliance with this obligation is a fine of up to R$ 250,000.00 (two hundred and fifty thousand reais), pursuant of Law 4,131, N° 9.069 E N° 11.371. The application of such penalties is regulated by Resolution No. 4,104 and Central Bank Resolution n° 3.85.
